The socioenvironmental function of rural property in a settlement of agrarian reform in the north of Rio Grande do Sul

The inaccuracies in the text of the Federal Constitution of 1988 prevents agrarian reform, determining that the social function of property and productivity be interpreted as distinct things. By virtue of the Federal Constitution, only areas that are unproductive from the economic point of view would be used for agrarian reform, while at the same time it claims expropriation of rural land that does not fulfill its environmental function. Therefore, this article proposes to deal with the historical and juridical challenges existing between expropriation of rural land and the socioenvironmental function of the rural properties in the north of Rio Grande do Sul and to analyze the relation that these settlers of the old Fazenda Annoni in Pontão/RS possess with the properties conquered through agrarian reform. The methodology adopted for th e implementation of the research involved a case study and followed the assumptions of the qualitative research, covering eight settlements of Annoni Farm. Of the 317 families that existed, 30 sitters participated in this study. In this way, the reflections, theoretical foundations, analyzes regarding the relations between settlers and rural properties were supported and described so that we can better visualize and understand these interrelationships.
